Contracts from service operators are the bane of many people’s lives. Despite OFCOM implementing what the industry knows as General Conditions, many operators continue to flout them.

Two such operators I have had the unfortunate pleasure of encountering on behalf of clients are, Chess Telecom PLC and Elite telecom.

Let’s look at the single biggest change in recent history of the telecoms market, ARC’s or automatically renewing contracts, you know the ones, where you sign up for x amount of months and if you miss the anniversary you are automatically tied in for the same initial period again. These contracts were removed from sale at the start of this year 2012, to consumers and companies of 10 or less, however, If my understanding is correct, from 13 September 2011, if you signed an ARC after this date OFCOM allow you to terminate the contract, giving the standard notice, at any time, whether you have served the full term of the contract or not.

OFCOM also, in their guidance to operators, make it clear that no early termination charges should be applied unless the operator has endured costs due to the supply of equipment, or free install. That’s only fair after all.

Yet the annoying thing is, operators are playing on your ignorance, Elite Telecom for example recently applied termination charges to a client who gave them the 30 days’ notice, even after my intervention and provision of OFCOM guidelines to them, (operators have a habit of not training their call centre staff properly, this allows them to plead ignorance and ensure the staff give their customers the wrong information, to the operators benefit of course) they, Elite, through their call centre staff, still tried to enforce the contract, which within their small print stated a minimum term of 24 months (more on that later). My client wasn’t aware they had signed for 24 months, and this was hidden away in the small print. The result is we have requested a letter of deadlock to allow us to take the matter directly to arbitration. Again, operators are required to have independent arbitrators and advise of who they are on their website. Check with your supplier to make sure they do.

Now, back to the 24 month contracts.

From May 2011 OFCOM introduced rules in relation to contract length for consumers and small business, 10 staff or less. The maximum length of contract is 24 months, however, you must be offered a 12 month contract as well, if your supplier has failed to offer you a 12 month contract and instead just signed you on a 24 month contract, then your supplier is in breach of OFCOM regulations.

Going back to Elite Telecom, within their general terms and conditions on contracts, they state their minimum term contract is 24 months. In other words their customers don’t have a choice and there for have never been offered a 12 month contract. In this scenario, OFCOM will deal directly with a complaint from you, as it is within the general conditions of supply from the operator where the operator has breached the OFCOM general conditions.

Chess Telecom PLC, where do I start, let me just say that in 20+ years in this industry Chess Telecom have to be the worst operator I have ever encountered. Recently, again a small business, less than 10 employees, gave the standard notice to cancel their contract, to their surprise, this is what they were told (now you will understand what I meant about not training their staff) Firstly, you signed a new contract in April 2012, the customer hadn’t and asked for a copy of the original contract from last year 2011, at which they were told “OFCOM tell us we only need to keep copies for 6 months” I actually have their general manager tell me this on an email re another client. I have yet to find anything from OFCOM which states or even implies this. I believe corporate law requires them to keep copies of contracts longer. Secondly, you are on an ARC, we have until Dec 2012 to take you off this, true except the client has given notice to terminate. Thirdly, you are on our best price guarantee contract (how many contracts is the client on I wonder) and by signing that, as long as we beat whoever you are going to you are resigned to us for the initial term, sounds an awful lot like an ARC to me? But also means that you can never leave Chess, hardly competitive practice is it?

Another guilty pleasure of Chess Telecom is to agree line rentals and call costs with you on your new contract. Don’t expect it to last, I can guarantee that within a few months your prices will have increased.

The UK Government has recently published a guide on Risks associated with cyber attacks.

The European Commission launched a consultation  in July, within the consultation are proposals that could see businesses required to report when their “essential” systems, including the internet, have been disrupted due to “cyber incidents”. The Commission said its aim is to “enhance preparedness, strengthen the resilience of critical infrastructure as well as to foster a cyber-security culture in the EU.”

Now, rather than later, is the time to start looking at how to secure your IT Networks, telecom networks and internet sites.

OFCOM proposed cap BT Charges

OFCOM has launched plans to price cap traditional technologies and the newer high speed Ethernet services, provided by BT.

The regulator claims that pricing controls  are required to counteract the “significant market power in a number of wholesale leased line services” that BT enjoys in the telecoms market.

These Leased line type services are part of the telecoms infrastructure, They enable voice and data traffic to be routed between locations. They are used by many businesses and organisations for a range of IT  platforms, such as internet access. They are also used by network communications providers, for example mobile networks.

OFCOM estimate the market to be in the region of £2billion per annum.

OFCOM has proposed a number of varying price caps that are dependent on the precise services organisations opt for with BT’s traditional technology. The suggestion is  that BT can impose year-on-year rate rises of 3.25% on top of inflation.

For Ethernet usage, Ofcom has proposed that BT decrease what it currently charges from between 8% and 16% a year after RPI has been factored in, depending on the type of service businesses have contracted for. In areas where BT face greater competition in this area, London for example, less restricted price controls have been suggested by OFCOM.  As a result the company will not be able to place any price rises for use of those lines for three years, under the plans.

Ofcom say that the proposals are “designed to align the prices of these BT products with their cost by 2015.” It also has said that the  controls it has suggested will incentivise BT to “make efficiency gains.”

“We want to ensure that the prices for wholesale leased lines services are not excessive and are broadly in line with the cost of provision,” OFCOM also said. “Wholesale prices for leased lines are likely to be reflected in retail prices. Excessive wholesale prices are likely to result in excessive retail prices, which would be to the detriment of consumers.”

Those affected by these proposals from OFCOM have until the end of this month to make representations to the regulator.

VOIP | How secure are your communications?

VOIP solutions, and indeed real time IP solutions like social media chat, vide0 conferencing etc could in actual fact be leaving the back door open for hackers.

Lets look briefly at the requirements for PCI DSS, part of the security requirement on the standard is that companies block all non approved channels of communication, screen all traffic and prohibit direct routes for inbound and outbound internet traffic (IP traffic). The trouble is many organisations forget about the communication traffic they cannot see, ones that use highly evasive techniques and are easily able to circumvent traditional security methods used to control the network.

Today, for example, our workforce expects instant messaging and other real-time communications tools e.g. IP Video conferencing (Skype for example), Voice over IP, and social networking to be ‘always on.

Using Skype as an example of how these operate,  Skype uses a peer-to-peer connection, is encrypted end-to-end,  and very often  tunnels through HTTP if that is the only firewall port open to it, negating the use of a URL filtering solution to control it.

This may result in many organisations who do not realise that their users have even installed real-time communications applications, such as Skype.

In August 2011, the ICO (information commissioners office) stated that companies who were not PCI DSS compliant could also be considered to be in breech of the Data protection Act.

Whilst PCI is concerned only with payment card protection, it can and should be used as a measure by which all orginisations secure their network. Payment Card fraud costs the UK over £300m per annum purely on card fraud, this does not take in to consideration other costs, or indeed the cost of network theft (known as Phreaking), which in the UK alone is costing us £1.6Billion.

As an example of what could happen, 45 million credit and debit card numbers were stolen from TKX, owners of TK Maxx, when a computer hacker broke into the TK Maxx wireless network and stole unencrypted credit card numbers.  TK Maxx failed to encrypt or truncate the card numbers and the loss to TKX is estimated to be between £328 million for card scheme fines, law suits, costs and management time and £1 billion in terms of loss of business and reputational damage. You can bet your last penny that TK Maxx increased security on their networks after this.
