PCI DSS Am I Affected?

This is a question I am often asked, the short and simple answer is yes.

PCI DSS and Call Recording

Many organisations that use voice recordings within the Contact Centre do so because it is required for business reasons, such as agent training or confirmation of verbal contractual agreements that are carried out over the telephone channel when selling services.

Depending upon the transaction type, regulatory requirements to keep any recordings (for varying periods of time) for playback apply. For businesses, particularly in the financial services and retail sectors, further requirements apply due to the fact that when purchase transactions are completed over the telephone using payment cards, certain data needs to be protected.

For organisations that are required to record telephone conversations and also take payment card details over the phonethe recording and storage of this data can become a PCI compliance issue.

Typically the call recording will record the whole conversation including the Primary Account Number (PAN) and the three or four digit security code (CAV2, CVC2, CVV2 or CID). In addition to the considerations required around the call recordings, enhanced processes and procedures are required for all of other stages involved in and around the initial call.

There are many things to be considered when recording a call containing cardholder data, it is vital to quickly determine what data needs to be protected, for what length of time and depending upon what analytical tooling is in place within your business; the appropriate management and protection of this information is paramount. It is worth noting that some of the largest fraudulent activities that occur are often from within the organisation, so it is imperative to ensure that voice recording is looked at from both a technology and a user process perspective, as they go hand in hand.

Some things to consider

  1. Is a formal Security Awareness Training programme in place and being maintained?
  2. Have you developed and implemented a set of PCI DSS compliant Policies?
  3. Are the call recordings stored securely?
  4. Is your network securely maintained and protected against attack?
  5. Do you maintain and secure a detailed set of auditable logs

Where technology exists to prevent recording of these data elements, such technology should be enabled. If these recordings cannot be data mined, storage of CAV2, CVC2, CVV2 or CID codes after authorisation may be permissible as long as appropriate validation has been performed. This includes the physical and logical protections defined in PCI DSS that must still be applied to these call recording formats.

What this means:

Essentially, the Card Verification Value (CVV) must not be retained post authorisation. In any event, and only as a last resort, where a CVV is retained it must be held subject to additional security controls to meet the intent of the Standard, but always via a compensating control.

Before any such compensation control can be implemented it must be verified by a Qualified Security Assessor (QSA) in turn approval must be obtained for the compensation control from the acquiring bank.

PCI DSS Compliance

Compliance with PCI DSS can be challenging due to the broad scope of the standard.

PCI DSS really is a security framework for protecting cardholder data. Compliance does not equal security, so merchants continue to experience data breaches – Data breaches at organizations of all types and sizes continue to make headline news.

A card-not-present transaction can include Internet, mail, fax, or telephone acceptance of credit card account information. e.g. during the course of performing their job responsibilities, telephone sales representatives will have access to full credit card numbers, billing addresses, and CVV2 codes.

PCI DSS is intended to protect cardholder data in the card-not-present industry as described above.

Despite the standard becoming mandatory for ALL since Oct 2010, many business and organisations are still unfamiliar with PCI DSS, or at least, uncertain as to how to comply with it. With the threat of fines of up to £300,000, and the risk of losing a merchant account and possibly irreparable damage to a businesses reputation should non-compliance lead to data loss or theft it would make perfect sense to find out more.

The Payment Card Industry (PCI – set up by the likes of Visa and American Express) requires that all retailers and businesses wishing to take payments over the phone must adhere to its strict regulations. With an increase in debit and credit card fraud, these regulations were recently tightened (January 2011) and businesses had until December 2011 to meet the new standards.

PCi-DSS

Pci-dss has twelve top level requirements. It is a mandatory requirement when working with credit card information. It is the payment standard used by Visa, American Express, Master Card and others.

PCI-DSS compliance is achieved via a combination of procedures, processes and technical controls. Individual compliance programs have been created around PCI-DSS by each merchant processor. PCI-DSS started as five different programs from the five major card brands of Visa©, MasterCard©, Discover©, American Express© and JCB©.

PCI-DSS is the payment standard used by Visa, American Express, Master Card and others.

There are now few areas where PCI-DSS is not compulsory for any businesses wanting to process payment card data.

Far from a static standard, PCI-DSS maintains a two-year revision cycle. Accordingly, the PCI-DSS standard requires a review of patch installation policies every month. For instance, PCI-DSS requires you to review firewall rules at least every 6 months.

The best thing of course is to avoid breaches altogether and that is what PCI-DSS is all about.

Pci dss is not merely a set of recommendations — non-compliance is not an option. It has four levels of attainment, each with different compliance validation procedures. It is required by Visa International, MasterCard Worldwide, American Express, JCB and Discover.

Pci dss was developed and is enforced by the payment card issuers. It has been clarified and added to several times over the years. It is one of the most important elements of commerce.

PCI-DSS and the ICO

Companies that fall below card payment standards risk being fined, ICO says, this is in addition to the PCI fines and costs!

Businesses that fall short of set standards for ensuring the security of credit card data could be fined, by the UK’s data protection watchdog.

The Information Commissioner’s Office (ICO) said that retailers that fail to process payment information in accordance with the Payment Card Industry Data Security Standard (PCI DSS) “or provide equivalent protection when processing customers’ credit card details” risk action being taken against them.

PCI DSS is the main standard related to storing payment card data and it sets out 12 requirements specifying steps which should be taken to ensure payment card data is kept safe both during and after transactions. The standard was established by the PCI Security Standard Council which comprises major payment card brands including American Express, Visa and MasterCard.

Under UK data protection laws the ICO has the power to fine organisations up to £500,000 for serious breaches of the laws which govern the protection of personal data. UK organisations that store personally identifiable information must adhere to certain principles, which include ensuring that data is not accidentally lost or damaged and is properly secure, under the provisions of the Data Protection Act.

The ICO issued its warning after finding that website hackers had been able to access the credit card information of 5,000 consumers that had shopped with cosmetics retailer Lush. The ICO said the data was “compromised” for four months between October last year and January 2011.

Lush received 95 complaints from customers who had been victims of fraud. It identified a “security lapse” in January this year and immediately restored the website’s security, the ICO said.

An ICO investigation found that measures Lush employed to secure customers’ payment details were “not sufficient to prevent a determined attack on their website”. The retailer’s methods for recording suspicious activity were not adequate either and this meant there was a delay in the time it took the company to spot that its security had been breached, the ICO said.

“With over 31 million people having shopped online last year, retailers must recognise the value of the information they hold and that their websites are a potential target for criminals,” Sally Anne Poole, Acting Head of Enforcement at the ICO, said in a statement.

“Lush took some steps to protect their customers’ data but failed to do regular security checks and did not fully meet industry standards relating to card payment security. Had they done this, it may have prevented the fraud taking place and could have saved the victims a great deal of worry and time invested in claiming their money back,” Poole said.

What this means for companies in the UK is that not only will they face potential fines of up to £300,000 from PCI they will also, potentially face a double fine from the ICO as well. That gives a total potential fine of up to £800,000. How many businesses could afford to pay that, as well as the costs involved in the recovery of any monies lost by the card companies caused by fraud following the failure of a business to take the measures required by PCI-DSS.

  8. Assign a unique ID to each person with computer access
  9. Restrict physical access to cardholder data
  10. Track and monitor all access to network resources and cardholder data
  11. Regularly test security systems and processes
  12. Maintain a policy that addresses information security for employees and contractors

 

What actions have you taken to ensure you meet the above requirements?

It is a requirement that ALL merchants are compliant by December 2011, that includes the smallest of retailer to the largest.

Imagine you are a small shop, your average transaction is £100 per day, it takes roughly 90 days to investigate a fraud, the cost you as a small business will be face with are, your average transaction value x the number of days taken to investigate, in my example this would be £9000, you then have the costs of the card company and a fine of up to £300,000 on top. Yes it is enough to put many a small business out of business, and this has indeed happened. Bear in mind as well, if the costs and fine does not put you out of business, then the banning of being able to take payment by card will almost certainly spell the end for your small enterprise.
